Property Manager’s, Landlord’s and Rental Property Owner’s Responsibilities
Beach Front Property Management, Inc. has a responsibility and a requirement under the law not to discriminate in the rental of property on the basis of race, color, religion, sex, handicap, familial status, or national origin. Moreover, we will not establish discriminatory terms or conditions in the purchase or rental, deny that housing is available, or advertise that the property is available only to persons of a certain race, color, religion, sex, handicap, familial status, or national original.
Renter’s Rights
As someone seeking to rent an apartment, home or condo, you have the right to expect that housing will be available to you without discrimination or other limitations based on race, color, religion, sex, handicap, familial status, or national origin. This includes the right to expect equal professional service, the opportunity to consider a broad range of housing choices, no discriminatory limitations on communities or locations of housing, no discrimination in the pricing or financing of housing, reasonable accommodations in rules, practices and procedures for persons with disabilities, and to be free from harassment or intimidation for exercising your fair housing rights.
Civil Rights Act Of 1866
The Civil Rights Act of 1866 prohibits all racial discrimination in the sale or rental of property.
The Fair Housing Act
The Fair Housing Act declares a national policy of fair housing throughout the United States, making illegal any discrimination in the sale, lease or rental of housing, or making housing otherwise unavailable, because of race, color, religion, sex, handicap, familial status, or national origin.
The Equal Credit Opportunity Act
The Equal Credit Opportunity Act makes discrimination unlawful with respect to any aspect of a credit application on the basis of race, color, religion, national origin, sex, marital status, age or because all or part of the applicant’s income derives from any public assistance program.
Violence Against Women Act (VAWA) & Victim Protection Policy
Beach Front Property Management is committed to providing housing free from discrimination, harassment, and retaliation. Consistent with the federal Violence Against Women Act (VAWA), applicable fair housing laws, and all other federal, state, and local legal requirements, Beach Front Property Management does not deny housing, terminate tenancy, refuse to renew a lease, or otherwise discriminate against an applicant or resident because they are or have been a victim of:
- Domestic violence
- Dating violence
- Sexual assault
- Stalking
- Human trafficking
- Elder abuse
- Any other protected act of interpersonal violence recognized under applicable law
Beach Front Property Management recognizes that behaviors or incidents resulting directly from domestic violence, dating violence, sexual assault, stalking, human trafficking, or elder abuse shall not, by themselves, be considered “disorderly conduct,” nor shall they constitute a material lease violation or criminal activity for purposes of enforcing company policies.
Accordingly, Rule 17 (Disorderly Conduct) and Rule 4 (Material Violation) of Beach Front Property Management’s Housing Rules and Policies Against Criminal Activity shall be interpreted and administered in a manner consistent with VAWA. Residents and applicants who are victims of domestic violence, dating violence, sexual assault, stalking, human trafficking, or elder abuse will not be penalized solely because they experienced or reported such conduct.
Housing decisions remain subject to all applicable lease obligations and legal requirements; however, Beach Front Property Management will evaluate each situation individually and in accordance with applicable federal, state, and local law.
Employee Training & Compliance
Beach Front Property Management maintains ongoing fair housing and VAWA compliance training for all employees involved in leasing, property management, maintenance, resident services, and compliance. Employees receive regular instruction regarding fair housing requirements, victim protections under the Violence Against Women Act, nondiscrimination obligations, reasonable accommodations, confidentiality requirements, and the proper application of company policies to ensure that all applicants and residents are treated fairly, consistently, and in accordance with the law.
Managers are responsible for ensuring these policies are consistently implemented across all Beach Front Property Management communities and are reviewed periodically to reflect changes in applicable laws and regulations.
